摘　　要：确立行政侵权精神损害赔偿制度是全面有效保护公民合法权利的重要方式,也是督促依法行政的有力保障,是国家、政府真正代表人民利益的体现。随着我国法律的日趋完善,人们法律意识的提高,构建具有我国特色的行政侵权精神赔偿制度,已具备一定的思想基础和有利的国内、国际环境。在阐释行政侵权精神损害赔偿内涵基础上,具体阐述了构建我国行政侵权精神损害赔偿制度的充分性和必要性,行政侵权精神赔偿的原则、依据等。Establishing the system of administrative tort compensation for mental damage is an important method of overall effective protection of citizens＂ legal rights, as well as the powerful guarantee in supervising administration by law, and the embodiment of the country and the government＇ s representation of people＇ s interests. The paper believes that with the improvement of the law in our country and the improvement of legal consciousness, there has been certain ideological basis and the favorable domestic and international environment to construct the system of administrative tort compensation for mental damage with Chinese characteristics. Based on the interpretation of the connotation of compensation for mental injury of administrative tort, this pa- per discusses the sufficiency and necessity of the construction of administrative tort compensation for mental damage of our country, and the mental compensation principles and bases of administrative infringement.
