宪政视野下农村民主管理制度运行的反思

摘　　要：农村民主管理制度作为现代基层民主的新制度模式,其制度中所体现的宪政价值丰富,其良性运行以充分发挥其对我国基层民主政治的积极建设作用具有非常重要的宪政意义。但是在宪政的视域中,农村民主管理制度的运行在微观的国家基层的宪政实践中未能得到很好的运行,主要存在如下问题:重视农村民主管理制度施行中民主外部运行的手段性和方法性,忽视农村内部民主管理过程中农民民主权利意识的培养和民主权利的保障;重视农村民主管理制度在政治层面的实践和运行,忽视在法治层面的施行和保障;重视农村民主管理制度实施中国家基层公共权力传输的单方性,忽视国家基层公共权力与农民民主权利"沟通与协商"的平衡性。对此应进行深刻的反思,结合我国农村民主管理制度实施面临的基层民主政治和宪政环境的实际状况,采取有力的措施不断予以规范和完善,确保农村民主管理制度的良性运行,在国家与农村社会的良性互动中推进基层民主政治的建设。Rural democratic management system, as a new model of modern system in grass roots democracy, has rich constitutional value embodied in its benign operation and plays positive role in the building of grass roots democracy. But under the constitutional vision, the system fails to run properly in the grass roots constitutional practice, and there are now mainly the following problems： neglecting the training of farmers＇ awareness of demo- cratic rights and the protection of the democratic rights of internal democracy in rural management process, only paying attention to external means and methods for the implementation of the system~ ignoring the rule of law and legal protection of the implementation of the system, only emphasizing its running and practice at political level; ignoring the balance through ＂communication and consultation＂ between grass roots public authority and democrat- ic rights of farmers, only emphasizing unilateral transmission from public power. These should be given a deep re- flection and effective measures should be taken to ensure the sound operation of the rural democratic management system and to promote positive social interaction in the construction of grass-roots democracy of the country.
