韩非子治吏思想的前提预设及运作思路

摘　　要：韩非子具有丰富的治吏思想，他曾明确强调“明主治吏不治民”。（《韩非子·外储说右下》，下引《韩非子》只注篇名）整部《韩非子》足有十万余言，半数以上的篇幅均在探讨如何治吏的问题。然而，现代中国学界对此并未予以足够的关注与研究。原因在于，现代学者多从政体理论人手去分析治吏问题，The presupposition of the conception of officer governance can be summarized as 'Shu Diao assumption' The so called 'Shu Diao assumption' considers that monarch-subject relationship is in fact a gambling relationship on interests and power.The ideal condition of monarch-subject relationship should be the interests exchange relationship dominated by the proper rules.The effects of the gambling between the monarch and the subject depend on the character of the rules.If the rule is righteous,the gambling result shows positive,otherwise the result shows vicious.Vicious gambling always refers to political corruption of abusing public power,which eventually leads to the decline of the social morality level~ The strategy of overcoming vicious gambling ultimately depends both on the political views and determination of the supreme ruler,and on the establishment of advantages on confirming asymmetric information and striking the spread of vicious gambling rule and the recessive rule maker.
