摘 要:道路交通事故侵权责任主体的确定是一个非常重要且广受社会各界关注的焦点问题。对于司法实践中经常出现的盗抢车辆、转借、租赁、分期付款、车辆买卖未过户以及车辆送交修理或质押、保管期间发生的交通事故损害赔偿特殊责任主体的认定,应通过运行支配和运行利益两项标准加以把握,由于原机动车所有人不再是车辆运行的支配者,也无从取得运行利益,因此一般情况下其不再是侵权责任主体,但以买卖等方式转让拼装或已达报废标准的机动车发生交通事故的除外,此时机动车所有人要和受让人承担连带责任。The determination of liability of subject in road traffic accident is a very important and complicated problem. Recently it always has been paid great attention in different sectors of Chinese society. In this paper, the author discussed some liability of tort of particular subject, such as the determination of liability of road traffic accidents caused by stealing cars, leasing, installment sale and vehicle to repair or during storage. The author elaborated her thought on the theories and practice of motor vehicle accident liability. Since the original owner of the vehicle is no longer dominated by the vehicle running, there is no way to running interests, under normal circumstances is no longer a subject of tort liability. However, where an illegally assembled motor vehicle or a motor vehicle reaching the standard of retirement, which has been transferred through sale or in any other transfer method, causes a traffic accident, the transferor and the transferee shall be liable jointly and severally.
