人大专门委员会与立法公正——以人大专门委员会与政府部门关系为中心的考察

摘　　要：人大专门委员会具有保障立法公正的重要功能,它在人员组成上与政府部门存在物质与情感牵扯,故极易影响立法公正。人大专门委员会的工作方式体现出对政府部门的依赖性,不利于保障立法公正。为了实现立法公正,应当重构人大专门委员会与政府部门之间的关系。可供选择的思路有两个:或者承认人大专门委员会与政府部门之间的关系现状,但须在二者之间建立规范透明的博弈关系;或者改变人大专门委员会与政府部门之间的关系现状,在二者之间建立真正的监督关系。The special committees of people~ congresses assume important responsibility on maintaining legislative justice. There exist material and spiritual relations among the members of the special committees of people＇ s congresses and government departments, so legislative justice is easily effected. Since the working meth- od of the special committees of people＇s congresses reflects the dependence on government departments, it does harm to safeguarding legislative justice. In order to realize legislative justice, the relation among the members of the special committees of people＇s congresses and government departments should be restructured.
