商品通用名称与商标权辨析

摘　　要：本文认为商品通用名称经过商业宣传及使用而获得显著性时可以作为商标加以注册,从而获得商标专用权。当然,商标专用权不可以滥用,在合理情形下应当允许非商标权人以非商标的形式在相关商品上合理使用该商标。为此,本文就防范注册商标转化为商品通用名称给出了合理化的参考建议。This paper thinks that the generic name of goods may be registered as a trademark after it is publicized commercially, but trademark rights can＇ t be abused. In a rational situation, the person who has not this trademark rights may use this trademark in the relative goods in the non - trademark form. For this, this paper gives some suggestions of prevention that the registered trademark should be trans- formed into the generic name of goods.
