摘　　要：基础性请求权与救济性请求权的区分,对于建立请求权二元体系进而理解民法上各具体请求权具有重要意义。但由于基础权与救济权的区分标准过于粗糙,一些具体请求权的性质问题仍然难以明确,其中物权请求权的性质之争即为典型。从物权请求权的历史沿革、物权的客体、物权的内容以及侵害与救济之间的利益平衡等方面可以证明,物权请求权不是物权的消极权能,而是物权的救济权。据此,是否以对受到侵害的利益加以救济为目的,并与之相应地于该利益受到侵害时产生,是区分基础性请求权与救济性请求权进而建立请求权二元体系的标准。It is significant to differentiate fi＇om the basic right of claim and the remedial right for constructing the binary system of the right of claim and for understanding all kinds of specific rights of claim in civil law. However, as the differentiating standard between basic rights and remedial rights is ambiguous, the nature of some specific rights of claim is still unclear, especially of the real right of claim. The real right of claim is not the negative effect but the re- medial right of the real right, which can be verified by the historical evolution of the real right of claim, the object and the contents of the real right, and also the balance of interests between damage and remedy. Therefore, if we want to construct the standard of the binary system of rights of claim, we should make sure of the differentiation of the basic rights of claim and the remedial rights the later occurs when certain interest is damaged and targets to remedy it, while the former does not.
