摘　　要：2012年发生的塞门亚"性别门事件"引起了全世界对体育领域中两性人权利保护的普遍关注。利用文献资料法、规范分析法、案例分析法等研究方法,以实体规则和程序选择的法学理论为起点,深入讨论解决两性人运动员参赛资格争议的可行性,提出对新近《条例》适用的可取与不足之处,并对国际体育仲裁院救济程序的择优选择提出建议。认为:若两性人运动员参赛资格争议满足所规定的前提条件,诉诸于国际体育仲裁院是最择优的选择。对两性人运动员参赛资格的法律救济的研究,是一个极具挑战性的国内外体育法前沿课题,也是进一步实现体育领域中公平正义的当务之急。Globe attention has been attracted to protect right of hermaphrodite athlete by Semenya Event in 2012. This paper used documentation method, norm analyzing, case study etc. and legal theory as start point to discuss the possibility of solving controversy for the eligibility of hermaphrodite athlete. Merits and shortcomings of the latest Regulation and preference of choice by CAS （Court of Arbitration for Sport） will be discussed in this paper. Appeal to CAS was the best choice if the controversy satisfied all the preconditions. The discussion was forefront subject of international sports law, as well as urgent equitable in sports.
