摘　　要：民族传统体育文化是我国文化遗产的重要组成部分,为了实现其体系化的有效保护,知识产权法的保护是近年来学者们关注的热点。从民族传统体育文化知识产权保护的伦理基础出发,论证民族传统体育文化知识产权保护的伦理正当性。无论是劳动价值理论、人格论、人权理论还是功利主义的激励论,都在一定程度上为民族传统体育的知识产权保护的正当性提供了理论支撑。National traditional sports culture plays a very important role in the system of Chinese cul- tural heritage. Recently, people focused on protecting these heritages in the intellectual property sys- tem. The essay focuses on the ethical basis of intellectual property protection of national traditional sports culture. The theory of labor value theory, personality, human rights and utilitarianism provide the soil of the legitimacy the use of intellectual property protection on traditional sports culture.
