摘　　要：罗尔斯通过坚守契约主义的原则立场,以最精致、最理想化的设计建构了一幅由契约主体选择两个正义原则的"完美"图景——"原初状态",这一状态虽然超越了古典社会契约论者关于"自然状态"的种种叙事,但是,原初状态中契约主体"自我"的丧失、契约环境的过分理性化、影响契约因素的过分理想化,导致原初状态的主体无法担当"公共反思和自我澄清"的能力,从而使这一重要的正义理论在彰显契约主义的理论优势时,也暴露了其自身具有的局限性。Rawls through the principled position on contract doctrine, with the most delicate, the most ideal design constructed a picture taken by the contract subject to choose the two justice principles --- “perfect” picture“original state”, the state although beyond the classical social contract theory on the ＆quot;state of nature＆quot;in all sorts of narrative , however, the contract subject “the origi-nal state of the loss of self”, contract object too much influence over ideal contract factors , leading to the main reason , the original state could not act as the “public reflection and self-clarification ability”, which is a important theory of justice in the theoretical advantage of contract doctrine, also exposed the limitations of its.
