摘 要:征地制度改革是党的十八大确立的深化经济体制和土地管理制度改革的重要任务之一。征地补偿是土地征收制度的核心问题,对农民土地财产权益的私法保护是其制度建构的基点所在。我国现行公法理念下构建的集体土地征收补偿制度未能充分反映补偿的私法属性,存在着补偿双方主体地位不平等、补偿内容有悖于市场公平原则、程序缺乏规范性和可操作性、民事解决纠纷机制不完善等制度缺陷,导致征地纠纷频发和矛盾突出。只有立足于我国土地制度的本土化,借鉴国外较为完善的土地征收补偿制度,在私法理念的指导下对我国土地征收补偿制度进行改革和完善,才能切实保护被征地农民的合法财产权益和真正实现公共利益与私人权益的平衡,彰显制度的公平和正义价值。The land expropriation system reform is one of the important tasks of deepening economic system and land management system reform established in the Eighteenth National Congress of the CPC. The expropriation compensation is the core issue of land expropriation system, and the farmers' land property rights protected by the civil law is the starting point for its system construction. Under the guidance of the public law idea, collective land expropriation compensation system does not reflect the private law nature of compensation in China. Problems such as the unequal status of both sides, violation of the principle of market fairness, being not normative and operational in compensation program, and lacking dispute resolution mechanism by civil law in compensation, lead to serious compensation disputes. Referring to the foreign expropriation compensation system on the basis of the localization of land system in China, we should reform and perfect our compensation system under the guidance of the private law idea, in order to effectively protect the legitimate property rights and interests of the landless farmers and achieve a balance between the public interests and private interests and highlight the value of fairness and justice of the system.
