我国现行体育法律文本法律责任规定的缺陷与完善

摘　　要：体育法律责任规定要遵循体育立法原则并体现体育法保障公民体育权利的价值导向。我国现行体育法律文本法律责任的规定存在逻辑结构不严、责任形态混杂、内容规定含糊、救济方式缺位等缺陷。要完善之必须建立法律责任与义务性条款的对应关系;建立完善的体育法律责任体系,实现责任形态合理配置;明确责任主体和执法主体,量化法律责任;加强同上下位法以及同位法中的法律责任条款衔接和协调,并体现体育的特殊性;增加权利救济的具体方式条款。The stipulation of sports legal liability must follow sthe ports legislative principles and embody the value guid- ance that sports law guarantees the sports rights of the citizens. There are some defects in the stipulation of legal liability in the current sports law texts in China, such as imprecise logical structure, mixed liability forms, vague stipulation con- tents, and lack of remedy methods. To perfect it, corresponding relation should be established between provisions of legal liability and obligations. Perfect legal liability system of sports should be set up and rational allocation of liability forms should be realized. The subject of liability and law enforcement should be specified and legal liability should be quantified. The convergence and coordination between provisions of legal liability should be strengthen and embody the particularity of sports. The remedy methods for rights in the stipulation of legal liability should be added.
