摘　　要：危险驾驶罪的设立体现了在风险社会下保障公民权利的需要。它属于危险犯,其成立并不一定要出现实害结果,而是只要具有侵害法益的危险即可。其侵害的法益应为不特定或者多数人的生命、身体、重大财产的安全以及公共生活秩序的和平与安宁。犯罪客观方面主要为在道路上驾驶机动车追逐竞驰,情节恶劣以及在道路上醉酒驾驶机动车的行为;犯罪主体为一般主体;犯罪主观方面为明知自己的危险驾驶行为会发生危害社会的结果或危险,而希望或放任这种危害结果或危险的发生。另外,正确认定该罪与交通肇事罪和以危险方法危害公共安全罪有重要的意义。The establishment of the crime of dangerous driving reflects the need to protect the rights of citizens in the risk society.
