摘 要:农村土地流转作为破解制约我国经济和社会发展的"三农"问题的一种探索,刺激全国各地区分别从各自实际出发进行多样性方式的实践,具有代表性的是天津市单纯"宅基地换房"与嘉兴市"两分两换"模式下的农村宅基地置换城镇住房尝试。通过对两试验区的典型模式进行分析,找出这些模式立论的理论基础并探寻这些基础的局限,进而探究出农村宅基地置换城镇住房的价值向度是资本价值向度,忽略了农村宅基地天然具有的人权价值向度。The rural land transfer is the exploration, and it can solve the "three rural" problems that restrict the economic and social development of China, and it stimulates the practice of the diversity methods of the rural land transfer in the Various Regions all of the country according to the respective reality. The typical attempt of the rural homestead exchange for the urban housing is the pure "homestead exchange for housing" in Tianjin and "two-distribution and two-exchange" in Jiaxing. Getting through the analyses of the typical modes about the two trial area, we find out the theoretical foundation and explore the limit of these foundation. On the basis of these discoveries, we can come to the conclusion that the value dimension of the rural home- stead exchange for the urban housing is the value dimension of capital, and elides the value dimension of human rights that the rural homestead had be provided naturally.
