摘　　要：本文在相关文献基础上建立了包含发达国家和发展中国家企业创新的理论模型,推导出知识产权对东道国企业研发投入的影响机制以及发展中国家知识产权的变动约束,并用中国省级面板数据进行检验。结果表明,现阶段中国知识产权保护水平尚未对中国企业研发投入产生正效应;外部技术模仿并没有正向影响中国知识产权保护水平,经济发展和国内自主创新力量集聚才是推动其提高的主要因素。本文结论对于正确认识和利用中国知识产权保护制度具有启示意义。Since reform and opening, China＇ s economic growth is mainly dependent on the advantage of labor cost, the government＇ s massive investment, as well as the export of low-end chain. This traditional extensive mode of economic growth is bound to be unsustainable. To promote sustainability of economic growth, we must change the mode of economic growth, and improve the innovation role in economic growth. Innovation is inseparable from the support of the intellectual property system, however, China＇ s intellectual property system was lately established in 1984, from the ＂Patent Law＂ enacted, in about 30 years, China has completed the intellectual property, as well as 200 years of developed legislative process. What is the impact of China＇ s intellectual property system on technologi- cal innovation ,what is the mechanism？？ In the current economic situation ,what China should implement policies of intellectual property to adapt to technological innovation .9 Follow these questions, on the basis of the relevant litera- ture review, this paper build a unified analysis framework, which Include intellectual property, national R＆D invest- ment, technology spillover channels, and conduct a comprehensive system study to protection of intellectual property on the impact of technological innovation. From the point of view of theoretical analysis, in open economy, on the one hand, a country＇ s technological in- novation from domestic enterprises, on the other hand from technology spillover. Firstly, this paper analysis of the im- pact of intellectual property protection and independent innovation spillover mechanism, and found that intellectual property protection on a country＇ s technological innovation produces both incentive effect, also Inhibitory effect. Incentive effect is to reduce the national R＆D enterprise technology spillover, encourages domestic enterprises to independent innovation, inhibiting effect is to increase the cost of domestic firms to imitate.
