论行政边界区域水事纠纷的可诉性

摘　　要：我国行政边界区域水事纠纷主要是由有关地方政府协商或上级政府协调解决,诉讼在解决行政边界区域水事纠纷中的地位和作用没有受到应有的重视。然而,强化诉讼机制是国家实现"集中统一领导"的政治目标和国家法制统一的最佳选择,在解决行政边界区域水事纠纷中具有无可替代的重要地位。要强化诉讼机制首先要对行政边界区域水事纠纷的可诉性进行分析。行政边界区域水事纠纷可分为"行政边界区域政府间水事纠纷"、"行政边界区域民事主体间水事纠纷"两类。前者不具有可诉性,后者才具有可诉性,应该避免将这两类纠纷混淆而使之泛政治化。对具有可诉性的行政边界区域水事纠纷需要优化诉讼解决机制,需要实现区域水事司法"国家化"、"专门化",同时加强广泛的区域司法协助。In China, water disputes in inter -jurisdictional areas are mainly resolved by consultations between relevant local governments or coordination by higher - level governments, and the role of litigation in resolving them is seriously neglected. However, strengthening the litigation mechanism is the best choice for achieving the ＂national centralized and unified leadership＂ political objective and creating a national unified legal system, and it is irreplaceable in solving water disputes in inter -jurisdictional areas. To strengthen the litigation mech- anism, first of all, we must analyze the actionability of water disputes in inter - jurisdictional areas. Water dis- putes in inter- jurisdictional areas can be divided into ＂water disputes between governments＂ and ＂water dis- putes between civil subjects in inter -jurisdictional areas＂. The former is not actionable, and the latter is. Peo- ple should avoid confusing the two kinds of disputes and politicizing them all. The litigation mechanism for ac- tionable water disputes in inter - jurisdictional areas needs to be optimized to achieve judicial ＂nationalization＂ and ＂specialization＂ in dealing with water disputes in inter- jurisdictional areas, and, at the same time to strengthen widespread judicial assistance in inter -jurisdictional areas.
