中日钓鱼岛之争中美国立场的考察

摘　　要：中日钓鱼岛之争是美国一手制造的,美国因素不可或缺。美国政府一面声称对钓鱼岛主权归属不持立场,另一面却扬言《美日安保条约》适用钓鱼岛,这就存有适用钓鱼岛说和不适用说两种截然对立的观点。尽管与美国政府的立场相比,其国内多数学者及相关人士所提出的观点具有一定的客观性,但也存在以《旧金山和约》和《归还冲绳协定》所涉条款合法有效为前提。美国政府理应尊重历史和国际法,承认钓鱼岛及其附属岛屿属于中国领土。同时,中美日学界应加强对钓鱼岛问题的共同研究,厘清相关历史和法理问题,进而推动中日通过谈判和平解决岛屿争议。The U. S. factor is mainly caused by the United States and is indispensable for the Sino-Japanese dispute over Diaoyu Islands. The U. S. government claims that U. S. is non-committal about which party owns sovereignty over Diaoyu Islands. At the same time, it emphasizes that US-Japan Security Treaty applies to Diaoyu Islands. Some scholars hold it applies to Diaoyu Islands, the others think otherwise. Althouzh comnared with the U.S. government＇ s position, the arguments put forward by of the majority of academics and relevant persons have certain objectivity, there is a precondition, that San Francisco Peace Treaty and Agreement between Japan and the United States of American Concerning the Ryukyu Islands and Daito Islands are legal and valid. The U.S. government should respect history and international law, and recognizes that Diaoyu Islands are Chinese territory. At the same time, the Chinese, American and Japanese scholars are required to strengthen joint research on Diaoyu Islands, and clarify the relevant historical and legal issues, so as to promote China and Japan to resolve Diaoyu Islands issue through negotiations peacefully.
