摘　　要：创新驱动发展战略与专利制度之间具有紧密的内在联系,专利、创新、发展三者呈循环驱动之格局,即专利驱动创新,创新驱动发展,发展反哺专利、驱动再创新。然而,由于现行专利法律制度与创新驱动发展战略的内涵之间并不具有天然的契合,因此需要以创新驱动发展战略之内涵为导向、以绿色专利制度之构建为突破口,并从实体制度、程序制度和激励制度等三个维度加以变革,以因应实施创新驱动发展战略之需。Innovation-Driving Development Strategy is inherently related to patent system. ＂Patent- Innovation- Development＂ constitutes a circulating-driving system to promote modem economic and social development, which means that patent drives innovation, innovation leads to development and development in return push forward patent and innovation. But the current patent system is not in essence consistent with Innovation-Driving Development Strategy, so it is necessary to transform the substantial, procedural and incentive system of the current patent system with innovation-driving development as orientation and green patent system as breakthrough to ensure the implementation of the Innovation-Driving Development Strategy.
