海洋行政规划视域下海洋生态补偿制度之构建——从概念分析到行动路径

摘　　要：海洋行政规划下的生态补偿制度是实现海洋生态正义的制度载体。海洋行政规划是海洋生态补偿制度的顶层设计和政策框架,不仅为构建海洋生态补偿制度提供法定依据,更能引导和促进海洋生态补偿实践的展开。海洋行政规划下海洋生态补偿制度构建的具体路径应当分两步:首先在海洋总体规划中确立海洋生态补偿的制度框架;其次,在其他海洋行政规划中落实生态补偿的具体制度。The marine ecological compensation system under marine administrative planning is a com-prehensive system to achieve marine ecological justice .Marine administrative planning is the top-level de-sign and policy framework of the marine ecological compensation system .It not only provides a statutory basis for the construction of marine ecological compensation system ,but also guides and promotes the ex-pansion of marine ecological compensation practices .The marine ecological compensation system under marine administrative planning should be constructed in two steps ：first ,we should establish institutional framework of the marine ecological compensation by the overall marine plans ;secondly ,we should imple-ment the specific system of marine ecological compensation by other marine administration plans .
