摘 要:我国现实中雇主随意性滥用惩戒解雇权、侵害劳动者合法权益的现象屡禁不止。如何禁止雇主惩戒解雇权滥用,域外国家以德、日为代表和我国台湾地区有着较为成熟的理论与实践,其中,首推将作为行政法"帝王条款"的比例原则引入劳动法惩戒解雇制度中。这一点,在我国远远未引起足够重视。文章在总结比例原则的基本原理、域外国家和我国台湾地区的做法的基础上,初步分析论证劳动法惩戒解雇制度中何以可能、如何可能适用比例原则,进而使得我国劳动法惩戒解雇制度尽可能得以完善。Phenomenon of employers arbitrary abuse of disciplinary dismissal right and infringing upon the legitimate rights and interests of workers repeated in the reality of our country. How to prevent employers from punishment abuses the dismissal power,other countries such as Germany,Japan and China's Taiwan region has a theory and practice which is more mature. They put proportion principle which is'King provision'of the administrative law into the law of labor discipline in dismissal system. This point is not paid enough attention in our country. Based on basic principle of proportion principle and the practice in foreign countries and China's Taiwan region,the paper put on the preliminary analysis about why and how apply the proportionality principle in the disciplinary dismissal system,aiming at improving disciplinary dismissal system of the labor law of China.
