摘　　要：中国共产党第十八届三中全会提出废止劳动教养制度。通过分析国外的保安处分制度、青少年司法制度,对建立违法行为矫治法提出建议:违法行为矫治法应定性为行政强制措施,应遵循处罚法定原则、公正公开原则和保障矫治对象权利的原则,实行决定权司法化,建议对违法行为的矫治对象矫治期限定为三个月至两年,坚持以人为本维护人权的原则,以实现依法治国和保障人权的实质性统一。The 3rd plenary of the 18th CPC congress proposes the abolition of the reform schools. This article reviews the international security measures,and legislatures on juvenile justice,claims that the cor- rections of the legal violations should rely on legislatures as compulsory administrative measures, follow the principles of statutory punishment and justice to fully protect the rights of the subjects and adhere to the rule of law. The duration for the correction is between three months to two years.
