摘  要:如何规范业主决策物业管理事务的过程取决于投票规则的设计。然而,我国法律在如何设计投票规则方面尚无明确的规定。投票规则的设计涉及以下重要问题:(1)在何种情况下,投票将被作为决策物业管理事务的方法;(2)基于什么准则来设计投票规则。基于制度经济学原理,在设计投票规则时,物业管理者需依据减少交易成本、预防委托代理问题、避免财富转移及保护少数业主权益不受侵害的四大原则,结合辖区业主及物业自身的特点灵活选用投票规则,从而提高物业管理决策效率,顺利开展日常管理活动,实现创建舒适和谐生活环境的目标。With the process of urbanization in China, more and more people are living in multi-ownership residential buildings (MOBs). Although MOBs could relieve the pressure of housing, their management poses a great challenge to the owners who are required to participate in the decision-making process. Unfortunately, the current legal system provides no support to the voting rules in owners' decision making. Based on the definition of voting given by Barzel and Sass, this paper explored the following two questions: 1) Under what conditions, owners are required to vote for management affairs? 2) What are the principles of designing voting rules? The paper concluded that the following factors are relevant to the design of voting rules for an individual MOB, namely transaction costs of decision-making strategy, the possibility of principal-agent problem, the avoidance of wealth transfer, the protection of minority owners, the characteristics of owners and the features of the building.
