摘 要:从环境影响评价(简称环评)审批实践看,公众参与制度还没有真正落到实处,其中一个重要原因是立法本身存在缺陷与不足。浙江省政府制定相关规章和其他规范性文件,为落实公众参与环评活动提供了具体的实施依据。但现行规范文件依然存在种种弊端,主要有立法滞后与审批被动、规范抽象与概念模糊、程序漏洞与责任缺失、内容冲突与衔接脱轨等。为更好地服务于新一轮行政审批改革,需要运用法律适用技术消解规范不和谐,并进一步创新地方政府环评审批立法。From environmental impact assessment system has not been truly implemented. defects and shortcomings.
