摘 要:行政许可持有人违法行为记分制度作为一种行政许可后续监管制度,在制度定位上体现为一种数字化表现状态下的行政许可累犯责任规制模式,在行为过程上体现为一种数字化表现状态下的行政许可累犯惩戒预备行为;在法律后果层面上体现为由隐性向显性渐进转变的累积式累犯责任规制模式;在制度价值层面上体现为一种以降低行政违法行为复发率为目标的累犯责任规制模式;在制度现状层面体现为一种多元创制主体影响下的碎片化制度实践。违法行为记分制度法治化对构建国家统一行政累犯制度提出了现实需求,统一行政累犯制度的合理建构以准确进行制度定位为前提,以行政违法行为复发性为制度构建现实基础,以遏制行政违法行为复发为规制目标。As a kind of follow-up supervision system of administrative license,the marking system for marking the illegal acts of administrative license holders presents as a digitalized recidivist responsibility regulation mode of administrative license in the system orientation,serves as a digitalized recidivist punishment preparation act of administrative license in the process. It expresses as an accumulative recidivist responsibility regulation mode that gradually changing from recessiveness to dominance in the aspect of legal consequences,presents as a recidivist responsibility regulation mode that aiming at reducing the recurrence rate of administrative illegal acts in the aspect of system value,and serves as a kind of fragmented system practice influenced by plural initiative subjects in the aspect of system status. The legalization of the marking system for illegal acts provides realistic demands to the construction of the national unified administrative recidivist system,the rational construction of which acts on the premise of accurate system orientation,on the basis of the recidivity of administrative illegal acts,and with the regulation aim of restraining the recurrence of administrative illegal acts.
