我国跨流域调水生态补偿法律问题的探讨

摘　　要：跨流域调水是复杂的系统工程,协调调水沿线不同利益主体之间关系的焦点问题是生态补偿。生态补偿不仅要得到国家政策支持,而且有赖于法律的权威性、稳定性,切实保障生态公平与社会正义实现。跨流域调水生态补偿法律制度建设,应积极确认和引导不同类型补偿主体出现,受水区企业、社会组织及自然人都可以成为补偿主体;受偿主体不但可以是作为国家、社会组织和自然人的"人",也可以是生态环境;生态补偿标准暂不宜在国家层面作相关立法规定,但应明确其法定要素;健全生态补偿监督机制,应强化国家监督的作用,并发挥社会监督的有效性。Interbasin water transfer is a complex system engineerin stakeholders along the water transfer route lies in the ecological supports of the state policies and the authority, but also the stabi ecological and social justice. The ecological compensation standard is not temporarily suitable in the relevant national legislation and regulations, but it should be made clear its statutory elements.Therefore,a sound ecological compensation supervi- sion mechanism would be set up with strengthened national supervision, and effective social supervi sion.
