论我国司法鉴定启动权制度改革

摘　　要：司法鉴定启动权制度是司法鉴定程序中的重要组成部分,不仅影响着司法审判的客观公正性,更关系到当事人诉讼权利的保障。本文通过对两大法系司法鉴定启动权制度进行比较研究,在结合我国司法鉴定制度现状的基础上,对我国司法鉴定启动权制度改革进行了分析,并提出了相关建议。Start right system of judicial identification is one of the most important parts in judicial identification procedure,which affects not only the impartiality of judicial trial and protection for the litigation rights. This article provides analysis and advice basing on comparative study between the civil and Continental systems and the current situation in China.
