摘　　要：民族国家的政治宪法只是一种特殊的宪法,难以面向政治以外的其他社会领域执行构成性和限制性的双重功能,平衡诸社会系统的自治与扩张。在全球层面上,由于政治宪法始终无法运转,各种全球社会体制的离心倾向和相互侵犯更加严重,已经造成了新的宪法问题。全球社会宪法应运而生,旨在支撑和驯服不同的全球社会力量,因此呈现随体制而异的"片段化"形态。全球社会宪法片段之间必然发生的碰撞,应当依靠一种"新冲突法"加以解决。The political Constitution of nation state is a special Constitution, which could hardly car- ry out the constructive and restrictive function to other social field outside politics or balance self- reign and expansion of different social systems. Globally, due to the inactiveness of political Constitu- tion, the off center tendency and inter-infringement of different global social systems become more se- rious, which leads to new Constitutional issue. All this leads to the emergence of global social Consti- tution, which aims to support and conquer different social power and shows a ＂fragmentary＂ pattern due to different social systems. Different segments of global social Constitution must conflict against each other and this should be solved with a kind of ＂new conflict law＂.
