湘中地区农村宅基地使用权流转情况调查分析——以湖南省涟源市3个乡镇为例

摘　　要：对湖南省涟源市三甲乡、六亩塘镇、水洞底镇3个乡镇的实地问卷调查显示:尽管立法对农村宅基地使用权的流转严令禁止,但《物权法》的颁布实施并没有有效遏制农村宅基地使用权的流转。在湘中地区,农村宅基地使用权地下交易十分普遍,且缺乏有效的监管;土地资源浪费现象严重;土地所有者利益严重受损;农民融资困难。造成这些现象的原因主要有3个方面:城乡一体化进程的快速推进是导致农村宅基地使用权流转的外部动因;农民愈来愈强的融资需求以及对平等财产权利的追求是农村宅基地流转的内在动因;追求利益最大化的基层政府及政策环境是导致农村宅基地流转的驱动因素。The field survey of 3 townships of Lianyuan city, Hunan province, San Jia Xiang, Six Mu Tang, Shui Dong Di Zhen shows ： legislation forbids the use right of rural homestead, but the promulgation and implementation of Property Law doesn＇ t effectively curb the usage right circulation of countryside homestead. In Hunan region, the underground transactions of country- side homestead usage right are very common, and lack effective supervision; land resources waste phenomenon is serious; the in- terests of land owners are seriously damaged; farmers＇ financing is difficult. The causes of these phenomena mainly have 3 as- pects： the rapid advance of urban rural integration is the external causes of the rural land use right transfer; farmers increasingly strong financing demand and the pursuit of equal property rights is the intrinsic motivation of rural homestead circulation; the pur- suit of the grass-roots government and policy environment benefit maximization is the result of the driving factors of rural homestead circulation.
