摘 要:搜索引擎服务技术已使信息网络成为汇集人类知识的集散地。但搜索引擎服务技术在便利大众、活跃电子商务活动的同时,也产生了假冒商品充斥网络市场的负面效应。于是,越来越多的商标权人将搜索引擎服务提供商作为被告诉诸法院以维护自身的利益。网络时代下,假冒商品给消费者带来的损失究竟由谁承担?搜索引擎服务提供商真的要承担这份法律责任吗?基于此,分别从搜索引擎提供商、社会消费者和广告主三者维度进行考察,以追踪网络商标侵权行为的责任主体,寻找法律的应然状态。我们的研究认为:网络作为一个服务平台,只是交易的中介,不应被苛以严格的法律责任;无过错搜索引擎服务商及比较性广告主不应构成商标侵权之主体;除欺诈性广告主外,知假买假的消费者也应承担一定的商标侵权责任。即便如此,构建网络环境下商标权人权利救济之途径,应该从搜索引擎提供商制度监管、社会消费者责任和政府监管三个层面予以规制。Search engine service has made information network become a collecting and distributing center of human knowledge. However,while providing convenience services to the public and enlivening the electronic commercial activities,it has negative effects on the network market,in which fake and forged commodities prevail. Hence,to safeguard their own interests,more and more trademark holders take search engine service providers to court as the defendants. In the network era,who bears the losses of consumers brought by the fake goods? Does a search engine service provider take the legal responsibility for the losses? Based on the above,the paper examines search engine service provider,social consumer and advertiser respectively to trace the subject of liability for network trademark infringement for a legal solution. We hold the view that as a service platform,network,which is merely a trading intermediary,shall not be claimed for strict legal liability; no- fault search engine service provider and advertiser shall not constitute the subject of trademark infringement; besides the fraudulent advertiser,the consumer who deliberately buys fake goods shall bear liability for trademark infringement accordingly. Nevertheless,to construct an approach to right relief for the trademark holders under the network environment,we should have legal regulations in the aspect of institutional control of search engine service providers,responsibilities of social consumers and government control.
