摘 要:登记是不动产物权变动的要件,没有登记则不发生不动产物权变动的效果。在不动产交易活动中,基于双方申请原则,当交易一方因其利益考虑而拒绝或怠于履行登记义务时,相对方就不能实现其预定的物权效果,只能请求登记义务人协助登记,但我国法律没有规定不动产登记请求权。登记请求权与物权变动密切相关,旨在请求义务人协助不动产登记,属于一种民事实体权利;登记申请属于一种启动不动产登记的程序性权利,需要厘清两者的区别。不动产登记请求权具有体现意思自治与维护交易安全的价值,有其法定和当事人约定的根源,我国立法应当规定登记请求权制度,并应对登记请求权制度进行规范,从而为司法实践提供法律适用。Registration is elements of real estate changes. No registration is not real estate right change . In real estate transactions, based on the application of both principles, when one party to the transaction because of its interests and to refuse or fail to comply with registration obligations, the opposite party can not achieve its intended effect of real right. In this case, the opposite party can only request registration obligations to register, but in our country the law has not stipulated the real estate registration request. Registration request is closely related to changes in estate rights, sought the help of real estate registration obligations. Real estate rights registration request belongs to a civil entity. Registration application is a form of real estate registration which can start procedural rights. We need clarify the difference between the right and the registration request application for registration. Real estate rights registration request has embodied autonomy and maintained the security of the transaction value. Real estate rights registration request from the law and the parties agree. Our country legislation should provide for the registration request right system and the right to respond to to regulate the system, so as to provide judicial practice applicable law. registration request
