651起公共场所卫生行政处罚案件中问题的探讨

摘　　要：目的通过分析上海市长宁区卫生局卫生监督所2011～2012年公共场所卫生行政处罚案件情况，了解和掌握基层卫生监督员执法案卷制作过程中存在的问题，分析问题出现的原因，为下一步提高卫生行政处罚案件质量提供依据。方法对2011年1月1日至2012年12月31日上海市长宁区卫生局卫生监督所办理的公共场所卫生行政处罚案件进行质量分析。结论651起案件中147起存在各种问题占案件总数的22．58％，文书规范问题出现的频次最高；证据收集出现频次较高，关键性指标错误出现的频次相对最低。反映出公共场所卫生监督员队伍整体素质不高，执法水平参差不齐，指出加强公共场所卫生监督员的专业执法能力培训势在必行，加大执法人员的责任心培养，实行卫生行政执法责任追究制度。Objectives： By analyzing the cases of health administrative punishments of in 2011-2012, we try to understand and find out the problems existing in the producing of law enforcement files, analyze the causes of these problems, and to upgrade our ability of law enforcement of sanitary issues. Method： To analyze the cases of health administrative punishments in public places done by Health Supervision lntitute of Changning district Sanitation Bureall Shenghai from Jan.01, 2011 to Dec.31, 2012. Conclusion： Various problems existed in 147 out of 651 cases, accounting 22.58% of the total cases. Mostly, problems arise from the standardization of documenta- tion.Secondly, collection process of evidence causes some problems.Key performance indicators related problems oc- curred least frequently. It shouts that the overall quality of health the troop of heath supervison is not satisfactory and need to be improved though professional training. To enforce the system of Fault Responsibility Investigation in Health Administrative Law Enforcement is very necessary.
