洛香村互助性侗族习惯法规范与刑法冲突问题调查与思考

摘　　要：黔东南苗族侗族自治州从江县洛香镇的洛香村位于贵州侗族最核心的聚居区域,当地侗族习惯法内容包含有互助性规范,即村寨内的所有成员都有维护村寨公共利益的义务,村寨内任何成员的合法权利受到侵害时所有成员都有帮助的义务。一些触犯刑法的群体性事件源自于侗族习惯法中的互助性规范内容。不与国家法严重冲突的互助性习惯法规范有其存在的价值。Luoxiang Village is located in Luoxiang Township, Congjiang County of Qiandongnan Prefecture, Guizhou Province--a concentrated residence of Dong people. In this village the Dong people＇ s folk law contains mutually helpful norms regarding the protection of public interests and the help rendered to any villager whose legal rights are encroached. It is found that some criminal cases there are related to the mutually helpful norms. It is argued that the mutually helpful folk law norms that are not in conflict with state law should be allowed to exist.
