摘　　要：随着我国法治进程的不断加快和医疗卫生环境的不断变化,行政指导作为"市场经济国家关于市场功能、政府角色和行政模式的政策选择不断演进的结果,"具有柔和、民主的色彩,既体现了行政行为的目的性,又兼顾了市场经济的自由性,已成为政府主导医疗改革不可或缺的重要手段。但是,由于我国行政指导法律机制不健全以及现实中政府责任意识淡薄,使得行政指导影响了医疗改革的效果及目标的实现。对此,本文认为,行政指导法治化是促进医疗改革的重要途径。As the accelerating process of the rule of law and the constant change of social environment of medical treatment and public health,administrative guidance is the evolving result of market economy choices among the functioning of markets,the role of government policy choices and administrative patterns.The character of administrative guidance is soft and full of democracy,which not only embodies the administrative acts of purpose,but also takes into account the freedom of the market economy.It is an indispensable part of the government-led healthcare reform.Due to the imperfect of administrative guidance legal mechanism and the weakness of government responsibility,administrative guidance has a bad effect on the health care reform and is even contrary to the rule of law. Therefore,legalization of the administrative guidance is effective access for the administration of law and health care reform.
