摘 要:《物权法》和《国有土地上房屋征收与补偿条例》的出台,限制了非公共利益进行土地征收的行为。城市土地收储逐步呈现出市场回购的特征,政府与原土地使用权人对土地增值分享和博弈的过程日趋显著。土地收储利益分配已经成为我国土地收储制度和存量土地盘活制度的核心问题。本文全面梳理了目前我国土地收储实践中各城市颁布的各种利益分配政策,总结了政策的特点和存在的问题,以期为我国各城市土地收储与回购实践以及国家土地收储利益分配的顶层设计提供参考。Nowadays China has rolled out the policies of The Real Right Law of PRC and Regulations on the Expropria- tion of Buildings on State - owned Land and Compensation to limit the behaviors of non - public interests in land expropria- tion. The land reserve in city gradually presents the characteris- tics of the market repurchase. Moreover, the land added - value sharing and game between the government and the original land users are increasingly visible. The land - reserve profit alloca- tion has already become the core problem in land reserve and stock land invigorated system. This essay has summed up all kinds of the interest distribution policies of land reserve system in china, and analyzes their characteristics and existing prob- lems, which will provide preferences for the land reserve and re- purchase practice and the top - design of the land - reserve profit allocation in China.
