澳大利亚公共部门信息再利用中的版权保护——基于多元公共行政观的视角

摘　　要：知识共享许可协议是版权保护的一种重要方式,能极大促进公共部门信息再利用,即提高公共获取程度、明确再利用权利、扩大再利用范围。通过梳理澳大利亚知识共享许可协议的应用实践,并利用罗森布鲁姆的多元公共行政观来分别从管理、政治、法律的视角来分析澳大利亚公共部门信息再利用中版权保护架构,指出对我国的借鉴意义。Creative Commons License is an important method of copyright protection, which can greatly promote the re-use of public sector information, namely to improve the level of public access, to clarify the re-use of rights, and to expand the scope of re- use. By combing the application practice of Creative Commons License in Australia, and using the multi-perspective view of public administration of David H. Rosenblum, this paper analyzes the framework of copyright protection in the re-use of public sector infor- mation in Australia separately from the perspective of management, politics and law, and points out the reference to China.
