摘　　要：现行《中国人民银行法》将支付清算系统运行和系统参与者割裂,存在管理职责不清、手段不足和对支付工具的管理缺乏完善等问题。因此,建立健全完备的监管框架,划清对支付体系监督管理的职责和权限,提升相关法律依据的层级,完善支付结算法规体系,加强对支付体系的监管,是确保我国支付体系安全稳定运行的切实有效的举措。The current ＂law of the people＇s bank of China＂ separates the operation and participants of payment and settlement systems, there exists problems such as unclear management responsibility, lack of means and lack of the perfect management of payment tool. Therefore, we should establish and improve the comprehensive regulatory framework, clear responsibility and authority of supervision and management of the payment system, improve the relevant legal basis level, perfect the rules for settlement of payment system, and strengthen the supervision of payment system, which are concrete and effective measures to ensure safe and stable operation of our payment system.
