摘　　要：《中共中央关于全面深化改革若干重大问题的决定》首次确定了生态空间管制政策。生态空间管制要求环境法基点从环境要素转向各环境要素构成的整体空间,环境法律体系所规制的环境问题从环境要素的污染和破坏转向兼顾整体生态空间的破坏。生态空间管制在环境法上的制度需求包括:确立保护和改善生态空间的立法目的;系统规定生态功能区规划制度、生态格局规划制度和生态控制线规划制度,以构建体系完善的生态空间管制法律机制;将环境影响评价制度和环境公众参与制度有针对性地具体化。The Decision on Major Issues Concerning Comprehensively Deepening Reforms put forward ecological space control requirement at the central environmental policies＇ level for the first time. Ecological space control proposes torture and challenge to the environmental law concept. It requires environmental law basis points from the existing single environmental ele- ments to the environmental elements that constitute the overall steering space, environmental problems regulated by the environment law system turn the single elements of the environment pollution and destruction to take the entire ecological space destruction. Ecological space control policies requires in environmental law including： establish the legislative purpose of protecting and improving the ecological space, systematically provide ecological function area planning sys- tem, ecological patterns and ecological control line planning system to build ecological space con- trol legal mechanism. And specifically design system combing environmental impact assessment system and environmental public participation and ecological space use control policies.
