摘  要:《中华人民共和国物权法》对城市绿地的规划、建设与管理工作提出了新的挑战。通过分析该法提出的居住区的绿地分类与现有绿地分类标准的异同,讨论了城镇公共绿地的认定方式、居住区法定绿地率的保障、公共所有绿地和业主共有绿地数量保证、绿地管理主体完善等关键问题,提出制度设计缺陷以及城市公共空间文化缺失是造成城镇公共绿地难以确定的主要原因。Property Law of the People's Republic of China poses new challenges to urban green space planning,construction and management.Through analyzing differences and similarities between residential green space classification proposed by the law and the current criterion for green space classification,this paper discusses such crucial issues as the ways of identifying public green spaces in cities and towns,the guarantee of legal greening ratio in residential areas,quantity assurances of the public-owned green spaces and those jointly owned by property owners,and the perfection of the green space management authorities.It argues that defects in institution formulation and the loss of culture in urban public spaces are the main reasons for the difficulties in defining public green spaces in cities and towns.
