摘　　要：基于公共利益目标,从发挥孤儿作品的历史与文化价值考虑,图书馆实施孤儿作品开发计划,必须通过行政性的强制许可、协会代表许可或行政机构与协会相结合的许可模式,获取孤儿作品的使用授权。在获取授权与使用孤儿作品的过程中,图书馆只有尽到合理勤勉地寻找权利人与恰当地使用作品的责任,才能有效规避著作权侵权的风险。Based on the public interest goal and the consideration of displaying the historical and cultural value of the orphan works, in the process of implementing the orphan works development plan, the library must gain use authorization of the orphan works through the administrative compulsion permission, the association representative permission, or the permission pattern which is codetermined by the administration and the association. In the process of gaining authorization and using the orphan works, the library can evade effectively the risk of copyright infringement only by taking the responsibility for seeking the obliges reasonably and assiduously and using appropriately the works.
