浅谈食品药品检验仪器设备招标采购合同的审核管理

摘　　要：目的加强仪器设备管理,完善采购制度,降低仪器设备招标采购风险和廉政风险,规避合同争议,确保招标采购工作遵循公开透明原则、公平竞争原则、公正原则和诚实信用原则。维护采购单位的合法权益,为检验检测工作提供条件保障。方法阐述仪器设备招标合同审核的重要意义,根据笔者在审核工作中发现的问题,归纳总结合同审核应注意的事项。结果与结论在合同签订阶段,根据相关法律法规,认真审核合同中的中标通知书、合同协议书、投标一览表和分项报价表、合同条款、技术规格偏离表和售后服务等内容,避免导致在验收或付款时发生纠纷、资金被财务部门拒付,规避合同签订风险,规范政府采购行为,提高政府采购资金的使用效益,维护国家利益和社会公共利益,保护政府采购单位的合法权益,促进廉政建设。Objective To enhance the management of food and drug testing instruments and equipment, improve the purchasing system, reduce the risk of procurement and integrity, and avoid contract disputes, so that the bidding and procurement can abide by the principles of transparency, fair competition, impartiality and good faith; to protect the legitimate rights of procurement entities and guarantee the course of detection and testing for food and drug. Methods The significance of reviewing the bidding and procurement contracts for testing equipment was discussed. According to the authors＇ experience in contract review, items that should be focused on during reviewing were summarized. Results and Conclusion According to related laws and regulations, when signing a contract, the following items should be focused on： the content of the bidding-winning notice, the contract agreement, the bidding schedule, the item tender offer sheet, contract terms, the deviation form for technical specifications, and after-sale service, to avoid disputes in acceptance or payment, refusal of payment, and contract risks, therefore standardizing the government procurement, improving the cost-effectiveness of government procurement fund, maintaining national interest and the social public interest, protecting the legitimate rights of procurement entities and promoting the construction of a clean and honest administration.
