摘　　要：现代科技创新是以市场价值为目标,将科技潜力转化为先进生产力的一系列创新活动。在科技创新过程中,政府在监控和协调整个社会体系方面有着不可或缺的作用和不可推卸的责任。政府的作用和责任是提供有利于科技创新的法律制度。立足产业升级、企业转型,从科技创新制度出发,借鉴世界各国的主要做法,认为我国应从科技法律上加以改进以支持科技创新。The modern theory of science and technology innovation refers to the market value as the goal ,it is a series of in-novation activities that transformed the potential of science and technology to advanced productivity .In innovation activi-ties ,the government in monitoring and coordination of the w hole social system ,has an integral role and unavoidable reponsibility .T he role and responsibility ,the main is to provide beneficial to scientific and technological innovation of eco-nomic law and administrative law in terms of a series of legal system .This thesis embarks from the science and technology innovation system ,the comprehensive study of the main methods of draw lessons from the nations of the world ,,briefly discusses on that our country present economic law support and guarantee for science and technology innovation ,as well as the need to improve in the future .
