摘 要:国家公产使用是国有财产使用乃至国有财产法基本制度的重要内容。国家公产使用主要包括公务用财产使用、公共用财产使用和企业用财产使用。分析公务用财产、公共用财产和企业用财产的使用及其限制,以及使用限制例外,可凸显国家公产使用与国家私产以及私有财产使用的重要区别,这也是国有财产的公私产或类似划分及其区别立法规制的原因所在。该研究对于我国国有财产市场转型及其立法规制改革具有启发意义。The usage of state public property is a very important content of usage of state property and its basic system of State Property Law. The Usage of state public property includes the usage of property of official usage, property of public usage and property of enterprises" usage mainly. Based on this basis, I analyze the usage and its limitations about property of official usage, property of public usage and property of enterprises" usage, and the ex- ception of the limitations of their usage, which can highlight some important differences between the usage of state public property, the usage of state private property, and the usage of private property. This is the important reason why state property should be divided according to state public property and state private property, or other similar classification, and its differences of legal regulation, which has a very important guiding significance for a reform a- bout market transformation of state property and its legal regulation obviously.
