摘　　要：正义在人类政治及法的发展史上既有深远历史,又有深层复杂含义。西方正义观的发展传承过程反映了思想家们不懈的理性思考,是人类思想史上的宝贵财富。但西方非马克思主义正义观陷入了机械主义和"一劳永逸"的泥潭。相比较而言,马克思主义正义观是历史的、辩证的科学观点,是指导我们立法及制度构建的科学武器。Justice has both a long history and complex meaning in the development of human politics and law. The development and inheritance of the Western concept of justice reflects the tireless rational thinking process of thinkers, and is a valuable asset in the history of human thought. But Western non-Marxist concept of justice has dropped into a mechanistic and “Once-for-all” quagmire. Marxist conception of justice is historical, dialectical and scientific, and is a scientific weapon to guide our legislation and system establishment.
