摘 要:工程项目建设周期长,不确定因素多,项目众多的参与主体易产生分歧,甚至产生争议。对一些仅是工程专业认定方面的问题(如变更工程造价),采用仲裁或诉讼的方式,虽能解决争议,但花费的时间长、成本高,既不利于合同当事人合作关系稳定,又造成社会法律资源浪费。本文综述了建设工程争议评审制度的发展历程,分析了工程争议评审的特点及其与国外DAB争端裁决的不同之处,指出目前在我国实施工程争议评审制度的障碍,旨在探索完善其发展的对策,促进工程争议评审制度在我国的发展。There are many uncertain factors in the long-term process of construction projects, which make the main participants easy to generate differences, and even disputes. Solving some engineering problems by arbitration or action, such as alteration engineering cost, spend too much time and money. It has bad effects on the stable relationship of the contactors, and waste social law resources. This paper analyzes the characteristics of the engineering dispute review mechanism, compares this method with DAB (dispute adjudication board), and find out the obstacles to implement this method at present, aiming to explore measures to develop this mechanism and nromote its develonment in our country.
