耕地占补平衡制度的实施状况分析——基于浙江省临安市样本的研究

摘　　要：以临安市为样本,对其近5年占补平衡补充(新垦造)耕地进行了调查和检测,结果表明:补充耕地无论在数量、质量还是利用情况方面都未能达成耕地占补平衡制度的设计初衷。在深入分析补充耕地质量等次、利用现状及有关土地法管理法律法规执行情况的基础上,梳理出在耕地占补平衡制度执行中存在的问题,进而提出通过树立正确的业绩观,落实耕地保护问责制;优化非农建设用地选址,尽量少占用优质耕地;优化土地的开发整理复垦设计,提高耕地质量以及完善法律法规,切实做好补充耕地后续管理工作等方面来有效落实耕地占补平衡制度。The paper takes Lin＇ an City as sample, studies the supplementary cultivated land in recent fiveyears. The results showed that the quantity, quality and utilization of supplementary cultivated land is notfulfilled its designed function, on the basis of the in-depth analysis of supplementary cultivated land quality,the utilization situation and the implementation of laws and regulations related to management of land law, thepaper summarizes the problems existing in the practice of the balance system of farmland in occupation andsupplement, and puts forward by setting up correct view of achievements, implementing the accountabilitysystem of farmland protection; optimizing the non-agricultural construction land location, taking up less highquality farmland; optimizing the design of the land development and reclamation, improving the quality offarmland and perfecting laws and regulations, strengthening subsequently management works of supplementland to effectively implement the balance system of farmland in occupation and supplement.
