摘　　要：哈特的法律与道德的关系理论集中体现在他的《法律的概念》一书中,他认为新分析实证法学之所以坚持自然法的最低限度,主要是由于人的自然属性和社会属性决定的。但是由于社会的发展,认识能力的提高,人的社会属性成为人的首要属性,因此法律与道德的关系主要还是分离的。并通过分析、比较、演绎的方法,阐述为什么坚持分离的理由。the relationship theory of Hart＇s law and morality embodied in his ＂The Concept of Law＂, a book in which he believes the reason why the new law insists on empirical analysis of the minimum natural law, mainly due to the natural and social properties decisions. However, due to the development of society, awareness-raising capacity, human society attributes to become one of the most important attributes, so the relationship between law and morality is mainly separated. And through the analysis, comparison, deductive method, it explained the reasons why they stick to separation
