风险社会下我国食品安全犯罪的立法缺陷与完善

摘　　要：风险社会下,科技与食品的结合、利益追求的激烈化,我国食品安全犯罪在犯罪构成的主观、主体要件上出现了诸多与传统犯罪不一样的特点,食品安全犯罪的归责陷入困境。增设严格责任主义下的"风险犯"和提倡食品安全犯罪团体责任显得十分必要。食品安全犯罪立法体系上犯罪客体划分混乱、法规衔接不协调造成的司法运作困境又要求我国必须明确食品安全犯罪客体标准,整合食品安全犯罪于同一章节,设立危害食品安全罪。合理使刑罚提前介入,适当扩大食品安全犯罪圈,才能真正有效地实现食品安全的保护。Under the risk society, technology and food combination, the fierce pursuit of interests, China＆#39;s food safety crimes and tra-ditional crimes there have been many different features on the subjective, the main elements of the crime constituted a crime imputation troubled food safety .＆quot;Risk committed＆quot;criminal groups and advocates for food safety responsibility for the creation of strict liability under the doctrine is very necessary. Crime legislation on food safety systems division of criminal object confusion, uncoordinated regulatory con-vergence difficulties caused by the functioning of the judiciary and the requirements of the object of the crime must be clear standards for food safety, the integration of food safety crimes in the same chapter, the establishment of food safety hazards sin. Make a reasonable penalty early intervention, appropriate expansion of food safety crime ring in order to achieve a truly effective food safety protection.
