村干部的三重角色及政策思考——基于征地补偿的考察

摘　　要：村干部在征地补偿中有三个行动目标和三重角色:一是作为政府代理人尽量平稳地完成上级下达的征地任务;二是作为村民当家人与政府谈判,争取尽可能高的补偿标准;三是作为理性人,谋取个人利益最大化。我国现行征地制度赋予了村干部一定的政策空间,使其能够借助在村庄中的权力、权威和网络及与镇政府的熟络关系等实施越轨行为,包括参与"倒地"、挤占、挪用村集体所有的土地补偿费、向上级输送利益、默许农民的抢种抢建行为、套取青苗补助、提供内部消息等。村干部越轨行为的泛滥折射出我国征地补偿制度在政策设计和执行上存在问题。征地是政府行为,存在多层委托—代理关系,且土地出让金规模巨大,因此建立现代监管体系十分必要。During the land expropriation compensation process,village cadres have three action goals and perform as triple roles: the first is to be government agents,finish land expropriation compensation tasks given by the superior as smoothly as possible; the second is to be village leads,striving for compensation standard as high as possible; the third is to be rational people,making best of their own interests. The present land expropriation policies in our country provide village cadres with certain policy space,which makes it possible for them to perform deviant behavior with their power,authority,network as well as their relationship with the Town Government. These deviant behavior includes reselling lands,misappropriating or diverting land compensation fee of village collectives,making profits for superiors,acquiescing to peasants' actions of planting or constructing right before the land expropriation,obtaining subsidies for young crops,providing inside information and so on. The deviant behavior of village cadres reflects the problems on policy design and implementation of land expropriation compensation system. Land expropriation is a kind of government action. There is a multi-principal-agent relationship,and the amount of land-transferring fees is huge. Therefore,it is necessary to establish a modern regulatory system
