摘 要:随着城市对商业用房需求不断增大,已经建好的商品房出现了用途性质的变更,大量的"商业用房"改为"办公用房"。由于对"商业用房"概念的理解不同,缺乏明确的法律规定,加之购房者法律意识淡薄,导致交房时出现规划用途性质变更中关于违约责任认定、违约赔偿等问题。本文结合具体案例,详细分析了商品房交付中房屋规划用途性质变更的法律责任。With the city' s growing demands for mercantile occupancy, there are more and more housing planning use conversions, that is, lots of commercial buildings are converted into office buildings. There are problems during the conversion of housing planning use because of different understandings towards the concept of "mercantile occupancy", lack of clear legal provisions and weak legal consciousness of the buyers. The author analyzed the legal responsibility for housing planning use conversion in the delivery of commercial housing.
