摘 要:城中村改造在中国语境下的讨论既是一个老生常谈,又是一个非常有现实意义的问题。文章基于我国土地制度的现状,对集体土地性质下的城中村改造进行了分析,论证了PPP模式下土地集合信托在项目改造过程中面临的法律问题。文章分为上下两部分,本部分为第二部分,通过对法律文本分析和比较研究的方法,重点探讨土地集合信托的退出机制和集体土地的抵押融资问题,给出了相应的对策建议,为PPP模式下土地信托的推广使用提供有价值的建议。Renovation of urban villages is not just a cliche in the current situation in China, but an unsolved issue with realistic meaning. This paper demonstrates the legal issues arising from the using the land collective trust during the project development under the Mode of PPT, based on the current land system and the analysis on reform of urban village in the nature of collective land. This paper has two parts and this is the second part, which, by means of analysis of legal documents and comparative study, focuses on the exit of the land collective trust and the financing through mortgage of the collective land, and gives relevant suggestion. This paper provides valuable suggestions for extension of the land trust under the Mode of PPT.
